Chambers understands that certain matters settle or are vacated at the last minute, which negates the need for a hearing. When a booking is made in Counsel’s diary, whether or not the brief has actually been delivered or attendance undertaken, the following cancellation fees apply:

1. One full working day (excluding weekends) prior to the hearing – 100% of the brief fee shall be payable;

2. Three full working days prior to hearing – 50% of the brief fee shall be payable; and 

3. Thereafter (greater than three days' notice), no cancellation fee shall be payable.

This cancellation fee is to provide remuneration both for the preparatory work undertaken by Counsel, and the inability to undertake hearings as a result of the vacated hearing.
